The Cares Organization received its tax-exempt status under sections 501(c)(3) and 509(a)(2) of the Internal Revenue Code, which means we are exempt from federal income taxes and certain tax benefits.

Are donations to The Cares Organization tax deductible?

The Cares Organization is exempt from federal income tax under Sections 501(c)(3) and 509(a)(2) of the Internal Revenue Service Tax Code, and as such, is a nonprofit corporation and public charity eligible to receive tax-deductible donations. Each donation to The Cares Organization is tax-deductible to the extent allowed by law in your jurisdiction. According to the IRS, as a public charity classified under IRC Section 509(a)(2), donors can deduct contributions they make to The Cares Organization as provided in IRC Section 170. Our organization is also qualified to receive tax deductible donor advised funds, bequests, legacies, devises, transfers, or gifts under IRC Sections 2055, 2106, and 2522.

In addition, as a 501(c)(3) and 509(a)(2) public charity serving as a “sponsoring organization” our organization can establish, manage, and administer Donor Advised Fund (DAF) accounts as a preferred charitable vehicle for giving which allows a donor to make a gift, take an immediate charitable deduction, and recommend future grants made from funds in the DAF account. To maximize the tax benefits of charitable giving, it’s recommended to consult with a tax professional or financial advisor who can provide specific guidance based on your situation and the organization you’re donating to. They can help you understand the potential deductions, limits, and reporting requirements associated with your charitable contributions.

How do I claim the tax deduction and when do I get a donation receipt?

In the United States, public charities are required to issue donation receipts, often called acknowledgment letters, for any single contribution of $250 or more. This requirement is outlined by the Internal Revenue Service (IRS) for both the donor’s benefit and as part of the nonprofit’s compliance with tax regulations.

For donors who make multiple contributions throughout the year that add up to $250 or more, our organization will provide a summary of contributions in the form of a year-end statement or summary letter.

If a donor contributes non-cash items, such as clothing or household goods, and the total value of these items is $250 or more, the nonprofit must provide a written acknowledgment that includes a description of the items and whether any goods or services were provided in return for the donation.

If you donate on our website, you will receive your tax receipt in an email in a timely manner soon after you complete your donation and no later than year end in the same calendar year. If you mail your donation, we will email or mail your receipt to you at the address you provide with your donation. In accordance with IRS regulations we credit as the actual donor, the entity listed on the check or on the credit card used in making the donation. The written acknowledgment we send out helps generous donors like yourself substantiate your tax deductions when filing your income tax returns. Without proper documentation, donors might not be able to claim the deduction. We encourage you to visit with your tax professional for details on how to claim your tax deductions. If you did not receive a receipt or lost your receipt, please email us at: Compliance@TheCaresOrganization.org.

When should I make my tax-Deductible donation?

To make a charitable donation that may be deductible from taxes for the current year, kindly donate by December 31.

Does The Cares Organization have any particular political affiliation?

The Cares Organization does not have a political affiliation. Our organization will absolutely refrain from: a) Participating in political campaigns of candidates for local, state, or federal office in the US or abroad, and, b) Restrict any lobbying and/or advocacy activities to an insubstantial part of our total activities.

To maintain tax exempt status, the IRS places certain restrictions on section 501(c)3 organizations regarding political activities, with the following caveats:

  • No Substantial Political Intervention: Public charities with 501(c)(3) status are generally prohibited from engaging in “substantial” political intervention. This means that they should not participate in activities that support or oppose specific political candidates, parties, or legislation.
  • Permissible Nonpartisan Activities: Public charities can engage in nonpartisan activities related to advocacy and voter education. This can include conducting voter education programs, hosting candidate forums that treat all candidates equally, and encouraging voter registration and participation without endorsing any specific candidates.
  • Supporting Charitable Causes with Advocacy Components: Public charities can fund charitable causes that include advocacy components, as long as the advocacy is a means to achieve the organization’s charitable goals and not the primary activity. It’s important to ensure that the organization’s advocacy work remains within the boundaries of the law.
  • Expenditure Responsibility: If a public charity grants funds to another organization engaged in political advocacy or lobbying, it may need to exercise “expenditure responsibility.” This involves ensuring that the funds are used for charitable purposes and not for partisan political activities.
  • Transparency and Reporting: Public charities should maintain transparency and keep accurate records of their activities, including any funding of charitable causes that involve political advocacy. They must report their activities on their annual Form 990, which is a public document.

How can I find out financial information about The Cares Organization?

Public charities, as tax-exempt nonprofit organizations, are generally required to provide transparency and make certain financial information available to the public. This transparency helps our donors, stakeholders, and the general public understand how the organization is using its funds and operating. While the specific requirements can vary by jurisdiction, the following are common practices and requirements for public charities to post financial information for public viewing:

  • Form 990: Most public charities are required to file Form 990, which is an annual informational return with the IRS. This form provides detailed financial information about the organization’s activities, expenses, revenue, governance, and more. Form 990 is a public document and can be accessed by anyone, including donors, through various platforms like the IRS website, GuideStar, or our organization’s website.
  • Public Availability: Public charities must make their most recent Form 990 (or a version of it known as the Form 990-EZ or Form 990-N) available for public inspection. This often includes posting it on the organization’s website or providing copies upon request.
  • Annual Report: Many public charities prepare an annual report that summarizes their financial activities, achievements, and impact. This report is often published on the organization’s website or distributed to donors and stakeholders.
  • Financial Statements: Some public charities also provide audited financial statements or reviewed financial statements prepared by independent auditors. These statements provide a detailed overview of the organization’s financial health and are often included in the annual report.
  • Website Disclosure: Public charities are encouraged to have a dedicated section on their website where they provide access to financial documents, reports, and other relevant information. This can include links to Form 990, annual reports, and financial statements.
  • Public Disclosure Rules: Depending on the jurisdiction, there may be specific regulations or laws that require public charities to disclose certain financial information. Organizations need to comply with these rules to maintain their tax-exempt status.
  • Transparency and Accountability: In addition to legal requirements, public charities often choose to provide additional financial information as a way to demonstrate transparency, accountability, and their commitment to responsible stewardship of funds.
How does The Cares Organization’s spending on administrative costs compare with that of similar groups?

The allocation of funds for administrative costs in a startup nonprofit organization can vary based on factors such as the organization’s size, mission, operating model, and financial capacity. It’s important to consider benchmarks and best practices within the nonprofit sector, but also to recognize that each organization’s circumstances are unique. Here are some considerations when comparing administrative costs of a startup nonprofit with similar groups:

  • Sector Averages: Many nonprofit organizations strive to keep their administrative costs at reasonable levels. The sector average for administrative costs can vary, but a commonly cited benchmark is that administrative costs should ideally be around 15-20% of the total budget, and for many it reaches 25% or higher. This benchmark allows room for the organization to allocate the majority of funds to programs and services.
  • Startup Phase: In the early stages of a nonprofit startup, administrative costs might be relatively higher as the organization invests in setting up systems, hiring staff, and establishing its presence. As the organization grows and stabilizes, administrative costs may decrease proportionally.
  • Mission Complexity: The complexity of the nonprofit’s mission and programs can impact administrative costs. Organizations with multifaceted programs, regulatory requirements, or research components may have higher administrative costs due to the specialized expertise and resources required.
  • Scale and Efficiency: Similar nonprofit organizations might have different scales of operations. Smaller startups might face challenges achieving the same administrative efficiency as larger, more established organizations. Efficiency gains can come with growth and time.
  • Operational Structure: Administrative costs can also be influenced by the organization’s operational structure. Organizations that rely heavily on volunteers might have lower administrative costs compared to those that require a larger paid staff.
  • Donor Preferences: Some donors prefer to see a lower percentage of funds allocated to administrative costs, believing that a larger portion should go directly to programs. Communicating the value and necessity of administrative functions is important.
  • Transparency: Regardless of the administrative cost percentage, transparency in financial reporting is crucial. Nonprofits should clearly communicate how funds are used and the impact achieved.
  • Long-Term Sustainability: Startup nonprofits need to balance administrative investments with long-term sustainability. While minimizing overhead is important, underinvesting in essential administrative functions could hinder the organization’s growth and effectiveness.

When comparing administrative costs, it’s helpful to research similar organizations in terms of mission, size, and programs. Benchmarking against peers can provide insight into industry standards while also taking into account the startup organization’s unique circumstances and strategic priorities.

A solid reputation inspires Confidence in our ability to: Accomplish a mission; attract donor funding and support; draw a passionate and dynamic Board and team; operate efficiently and compliant with laws; and motivate people to seek our help for people and regions that need it the most!

Where does The Cares Organization carry out its project work?

The Cares Organization carries out its mission globally. While the majority of our funds are deployed into US based charities, we ensure these charities have a global reach.

Does The Cares Organization have projects in the US?

Absolutely! The Cares Organization is actively involved in projects across various cities and rural areas in the United States. We apply the same rigorous criteria and commitment to sustainability for projects here as we do globally. Our aim is to make a positive impact, and our projects in the US are a reflection of this dedication.

Are there countries where funds or projects are restricted?

The Cares Organization can operate globally, but there are certain countries and situations where additional caution and consideration might be necessary. The decision to fund activities or programs in specific countries is carefully reviewed, monitored and assessed by the organization’s Fund Policy Board, in consultation with its Board of Directors, and C-Level Executives; and decisions by the Board of Directors are based on a combination of legal, ethical, and practical considerations. Here are some factors we consider:

  • Legal Restrictions: Some countries have strict regulations and restrictions on the activities of foreign charities. It’s important that we thoroughly research the legal requirements and registration processes for operating in a particular country.
  • Political and Social Environment: We assess the political stability and social climate of a country. Engaging in certain types of activities or supporting certain causes might attract attention from local authorities or groups, potentially putting the organization and its beneficiaries at risk.
  • Humanitarian Crisis or Conflict: We do not participate in political conflict zones, war zones, front lines, or in controversial crisis. In countries facing humanitarian crises or human rights abuses in line with our charitable mission and laws and regulations for public charities, our organization will carefully evaluate whether our presence and activities would contribute positively to the situation. Working in such contexts requires sensitivity, cultural awareness, and a strong understanding of the local dynamics, in consultation with our legal counsel.
  • Corruption and Transparency: Some countries have high levels of corruption and lack of transparency. Our organization is cautious when providing funds in such environments, ensuring that the funds reach the intended beneficiaries and are used appropriately.
  • Partnerships and Local Engagement: Collaborating with reputable local partners can enhance the effectiveness and impact of our charitable efforts. Local partners can provide valuable insights into the local context, help navigate challenges, and ensure cultural sensitivity.
  • Risk Assessment: Our organization conducts a thorough risk assessments before entering a new country or donating to a charity with an active presence in that country. This includes assessing financial risks, security risks for staff and beneficiaries, legal risks, and reputational risks.
  • Alignment with Mission: Our organization ensures that activities in a particular country align with our mission and goals. Funding projects that are not within the organization’s area of expertise can lead to inefficiencies or unintended negative consequences.
  • Beneficiary Needs: Our organization carefully assesses whether the programs and services offered are relevant and meet the needs of the local population. Beneficiary participation and involvement in program design can enhance the impact and sustainability of initiatives.
  • Long-Term Commitment: Operating in another country requires a long-term commitment. Short-term interventions might not lead to sustainable impact and could even disrupt local systems and economies.

Ultimately, the decision to fund activities in a specific country are made with careful consideration of these factors and in alignment with our organization’s mission and values. It’s important for us to conduct due diligence, consult with experts, and prioritize the wellbeing of the beneficiaries we aim to serve.

Can The Cares Organization send me a copy of your articles and bylaws?

Our Articles of Incorporation and Bylaws are internal documents automatically, though our organization might choose to make them public. To apply for 501(c)(3) tax-exempt status with the IRS, for example, our organization had to attach our bylaws to the application. The IRS makes all of this public—including our bylaws. The short answer is, on a need-to-know basis, we can but requests must be made in writing and we ask you kindly allow for reasonable time to process your request. We can send these to you for free if you’re in the United States.
